How Long Do You Have to File an Alberta Injury Claim After an Out-of-Province Accident?

If you live in another province but were injured in Alberta, it is important to understand how much time you have to take legal action. Alberta law applies to any accident that happens within the province, and that includes the time limits, known as limitation periods, for starting a claim.
In most cases, you have two years from the date of the accident to file a personal injury claim in Alberta. This two-year limitation period is set out in Alberta’s Limitations Act and applies whether you live in Alberta or elsewhere in Canada. If you miss this deadline, you may lose your right to pursue compensation, even if your injuries are serious.
When the Two-Year Period May Start Later
There are situations where the two-year period might start later. This can happen if:
- You did not immediately know the full extent of your injuries or their impact on your life.
- The person responsible for the accident was not immediately known.
- You were a minor at the time of the collision.
This is known as the discoverability rule. It means the time limit may begin once you reasonably know that you were injured and that another party may be at fault. Even with this flexibility, it is still best to speak with an Alberta injury lawyer as soon as possible. Acting early helps preserve evidence and ensures your claim is filed within the right timeframe.
What Happens If You Miss the Deadline
If the limitation period expires, you generally lose the legal right to bring your claim to court. Insurance companies will usually deny late claims, and courts will dismiss them even if liability is clear. Some exceptions exist in very limited cases, such as when a person is incapacitated or was under a disability that prevented them from acting, but these are rare.
The best approach is to treat the two-year period as a hard deadline and start the process well before it expires. That gives your lawyer time to gather evidence, communicate with insurers, and properly prepare your claim.
How the Limitation Period Works for Out-of-Province Residents
If you live in British Columbia or another province, the limitation rules still follow Alberta’s law because the accident happened within Alberta’s borders. It does not matter where your insurance is registered or where you live. This can surprise people who assume their home province’s deadlines apply.
For example, BC has a two-year limitation as well, but some procedural rules differ, and Alberta’s courts have their own filing requirements. Working with a lawyer licensed to practise in Alberta ensures your claim is filed correctly and on time under Alberta law.
Other Important Deadlines
In addition to the two-year limitation, there are shorter notice periods in Alberta that apply in some circumstances. If your claim involves a municipality, a government vehicle, or an unidentified driver, there are additional forms and notice requirements that can be as short as 10 to 90 days. Insurance claims for Section B benefits also have specific timelines for reporting injuries and submitting expenses.
An Alberta injury lawyer can help you identify which deadlines apply to your case and make sure none are missed.
